1. Acceptance of Terms

Welcome to Targon, a service owned and operated by Manifold Labs, Inc., a Texas Corporation ("Manifold Labs," "we," "us," or "our"). By accessing or using the Targon platform and services (collectively, the "Services"), you acknowledge and agree to be bound by these Terms of Service ("Agreement"). If you do not agree with these terms, you must discontinue use of the Services immediately. This agreement is effective when you commence using the Services, or the Website (the "Effective Date").

2. Description of Services

Targon provides a platform for deploying, managing, and optimizing AI models. These Services may include API access, cloud-based model hosting, and related tools. Subject to this Agreement, the Company hereby grants you a non-exclusive right to access and use the Services.

Manifold Labs reserves the right to update, modify, or discontinue any aspect of the Services at its discretion.

3. User Obligations

As a user of our Services, you confirm that you are at least 13 years of age and satisfy your jurisdiction's minimum age requirements for digital consent. If you meet the age threshold for access but lack legal authority to consent, your parent or guardian must agree to these terms on your behalf. You are responsible for all user communications sent via the Services. You agree not to use the Services to transmit any content that:

• is defamatory, harmful to minors, obscene or pornographic
• violates third-party intellectual property rights or other laws
• is sensitive personal data, financial or medical information
• promotes or constitutes criminal activity

4. Intellectual Property Rights

All content, trademarks, and data on the Targon platform are the property of Targon or its licensors. Users are granted a limited, non-exclusive license to access and use the Services for personal or internal business purposes. Certain AI models available through the Services may come with third-party licenses. Users are responsible for complying with those terms.

5. Privacy Policy

6. Termination

Targon reserves the right to suspend or terminate your access to the Services at our discretion, without notice, for conduct that we believe violates this Agreement or is harmful to other users or the Services.

7. Warranties and Disclaimers

The Company warrants that:

• The Services will perform materially as described in the Documentation

Users acknowledge that:

• The Services are provided "as is" and "as available"
• The Company does not guarantee uninterrupted, error-free service
• Insights and communications from the Services do not constitute professional advice

8. Limitation of Liability

To the fullest extent permitted by law, Targon shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• your use or inability to use the Services
• any unauthorized access to or use of our servers and/or any personal information stored therein

9. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of Texas, without regard to its conflict of law principles.

10. Changes to the Terms

Targon reserves the right to modify these Terms of Service at any time. We will notify users of significant changes by sending an e-mail to registered users. Your continued use of the Services after such changes constitutes your acceptance of the new terms.
